Birchtree Centre Workshop – Terms and Conditions
1.1. The Birchtree Centre (Birchtree) may, at its discretion, accept or reject any booking submitted by an individual (the Customer) to attend a particular workshop hosted by Birchtree (the Workshop).
1.2. If Birchtree accepts the booking, it will notify the Customer by issuing a booking confirmation electronically.
1.3. Birchtree will deliver the workshop to the Customer at the site and time specified in the booking form unless otherwise notified by Birchtree to the Customer in writing.
1.4. The Customer must pay all fees to Birchtree for the delivery of the Workshop prior to the commencement of the Workshop in accordance with any invoices issued by Birchtree from time to time.
1.5. All material supplied to the Customer in connection with the Workshop will be protected by copyright, all rights reserved.
2. Rescheduling and Substitution
2.1. A Customer may make a request to change the details of a Workshop by giving Birchtree written notice at least 2 weeks prior to the date of the relevant workshop. Birchtree may, at its discretion, accept or reject any rescheduling request or charge an administration fee.
2.2. If Birchtree accepts a request made under clause 2.1, any amount paid for the Workshop will be credited to the rescheduled workshop.
2.3. A substitute may attend a Workshop on behalf of a Customer. The Customer must notify Birchtree of any substitutions in writing at least 24 hours prior to the commencement of the Workshop. A substitute attending a Workshop may be denied entry if written notification is not received in accordance with this clause.
2.4. Birchtree may, at its sole discretion, cancel a Workshop or change any details of a Workshop. Birchtree will notify the Customer of any changes to a Workshop as soon as is reasonably practicable.
3.1. The Customer may cancel a workshop by giving Birchtree written notice at least 1 month prior to the date of the relevant workshop. If the Customer cancels a workshop without the notice required under clause, Birchtree may charge a cancellation fee equal to all fees paid by the Customer for the seminar.
3.2. On cancellation of a workshop, the Customer must immediately return to Birchtree or delete all material provided to the Customer (is any) in relation to the Workshop.
4. Limitation and Exclusion of Liability
4.1. To the full extent permitted by law, all guarantees, warranties, representations, promises, conditions or statements regarding a Birchtree workshop, whether express or implied, and whether statutory or otherwise (including without limiting generality, guarantees, warranties, representations, promises, conditions and statements as to merchantability, suitability or fitness for any purpose, profitability or any other attributes or consequences of or benefits to be obtained from or in the course of using such services) are excluded except as otherwise expressly provided for in these Terms and Conditions.
4.2. Birchtree’s liability in respect of a breach of any statutory guarantee, warranty, condition or other term is limited to the provisions set out in clause 4.3 below.
4.3. To the full extent permitted by law, Birchtree’s liability for breach of any guarantee, warranty or other obligation, is limited, at the option of Birchtree, to any one or more of the following:
(a) the resupply of the workshop; and
(b) the payment of the cost of having the services resupplied.
4.4. Birchtree will not be liable for any indirect or consequential damages including loss of profits, revenue, data or use in any action in contract, torts or relevant statute law arising out of or in connection with the supply of a Birchtree workshop.
5.1. The Customer acknowledges that Birchtree collects and uses the Customer’s information from the booking form for the purpose of creating bookings, the development of future workshops and to inform the Customer of Birchtree events.
